What is EUDR?

Regulation 2023/1115 of the European Parliament and of the Council is Europe's response to the global and growing problem of deforestation. The aim of the Regulation is to ensure that products placed on and exported from the EU market do not contribute to deforestation or forest degradation both inside and outside the Union. The reduction of tree felling is also intended to contribute to the reduction of carbon dioxide emissions from the land-use sector and to regulate deforestation and forest degradation, which are caused, among other things, by the excessive expansion of agriculture for the production of goods.

The EUDR is in line with the objectives of key EU strategies, such as the European Green Deal and the EU Forest Strategy, supporting the protection of ecosystems and the sustainable management of natural resources. It is also in line with global environmental policy frameworks, including the United Nations 2030 Agenda and the Convention on Biological Diversity (CBD), promoting responsible supply chains and reducing deforestation on a global scale.

EUDR obligations

The EUDR refers to a closed catalogue of goods and related products. These include cattle, cocoa, coffee, oil palm, soybean rubber and wood. The Regulation prohibits the placing on the market, export and making available on the Union market of these products if they have been obtained or produced in a way that has contributed to forest degradation or deforestation.

In order to comply with the requirements of the Regulation, the data collection process must be initiated, due diligence procedures followed and appropriate declarations made using a specially designed system.

Large companies have the greatest obligations to EUDR, which have to collect data on the country of origin of the products, their number and the location of the parcels where they were produced. They are also responsible for carrying out the due diligence process and making a statement on the matter. Micro, small and medium-sized enterprises are required to keep basic data about their suppliers.

The data to be collected depends on the size of the company and the structure of its operations. These include, but are not limited to:

  • the name and type of the products concerned,
  • their number,
  • country of production,
  • geolocation of the plots on which they were produced,
  • the time period in which they were produced,
  • basic data on companies in the supply chain.

The Due Diligence process is carried out to determine whether the relevant products in the company's offer do not cause deforestation and comply with the relevant national production regulations — it checks whether the EUDR objectives are met. The first step is to gather relevant information about the products, their number, the country of origin, the exact location where they were produced, and information on deliveries. Together with their collection, a risk assessment is carried out to determine whether the products comply with the EUDR requirements. The assessment shall take into account, in particular, the risks of origin attributed to the country, the presence of forests or the situation of the indigenous population.

For small and medium-sized companies, the process can take about a month, while large companies need to reserve at least 3 months. The time taken to prepare a company for EUDR compliance directly depends on:

  • the structure and size of the company,
  • the quantities of the products concerned which the company has in circulation,
  • whether the company is the first entity to launch the product on the European market,
  • how product data is collected,
  • the length of the supply chain and the number of suppliers.

Not necessarily, but often the systems currently in operation need to be adjusted in order to effectively verify individual goods by HS/CN codes. The overarching goal is to reduce the time and money spent on collecting data. Modification in many cases means changing the coding system at the data aggregation stage, which is part of due diligence.

Cooperation shall begin by verifying whether the entity is covered by the Regulation. We map the degree of preparation of the company to implement activities in accordance with the EUDR. We then analyze the data and systems and build the process to complete the due diligence assumptions. In the next step, we prepare the company to complete the declaration and submit it, monitor its components and update it if necessary.
