Alongside the draft amendment to the Energy Efficiency Act, the criteria for classifying enterprises in terms of conducting mandatory energy audits of enterprises will change. Till now, the obligation covered large enterprises within the meaning of the Act of 6 March 2018 — Entrepreneurs' Law. A draft amendment to the Act imposes an obligation to conduct an energy audit on companies whose average annual energy consumption over the past three years is greater than 10 TJ and less than 85 TJ. Currently, every four years, large companies go to the Office of Energy Regulation. A statutory audit covers a minimum of 90% of the energy used by the enterprise.
